Dismissal of Anticipatory Bail Petitions in IHPL Fraud Case
Two anticipatory bail petitions filed by Surender Khanna and Nirmal Sidhu, two accused individuals in the Indian Heaven Premier League (IHPL) fraud case, were dismissed by a court in Srinagar. The Court of Additional Sessions Judge, Srinagar Farooq Ahmad Bhat, rejected the pleas of Khanna, who was the “League Commissioner,” and Sidhu, who was accused of fleeing from the hotel without settling pending bills and match fees.
The fraud case, registered under sections 316(2) and 318(4) of the Bharatiya Nyaya Sanhita, involved the organizers of IHPL allegedly deceiving players, support staff, hotel management, and spectators by collecting money and abandoning the event. The league, which featured international cricketers like Chris Gayle and Jesse Ryder, was organized by the Mohali-based Yuva Society at Bakshi Stadium, Srinagar.
According to the prosecution, the accused individuals left the hotel abruptly, leaving behind unpaid bills and fees. They also collected money from spectators for matches that never took place. Investigations revealed transactions exceeding Rs 4 crore in the society’s account, along with fraudulent trials of young cricketers in Srinagar, Kishtwar, and Jammu.
Opposition to Bail Applications
The prosecution argued against granting bail, emphasizing the gravity of the economic offense and the need for custodial interrogation to trace the money trail. The court, in dismissing the petitions, highlighted the societal impact of economic offenses and the seriousness of the allegations. It noted that one co-accused had already been arrested, and others were evading arrest.
As the investigation continues, police have hinted at filing supplementary charge sheets after further arrests and examination of financial records. The court directed Khanna and Sidhu to surrender for interrogation, indicating that there were no exceptional grounds for protection from arrest.
