Economic Offences Wing Chargesheet Filed Against Srinagar Resident for Property Forgery
In a recent development, the Economic Offences Wing (EOW) Kashmir of Crime Branch J&K has submitted a chargesheet before the Chief Judicial Magistrate Court in Budgam against a Srinagar resident. The individual in question stands accused of forging property documents to falsely claim ownership of a housing plot at Government Housing Colony in Ompora, Budgam.
The chargesheet, presented in connection with FIR No. 61/2023 under Sections 420, 467, 468, and 471 of the Indian Penal Code at the EOW-Kashmir Police Station, sheds light on the alleged fraudulent activities surrounding Plot No. 1165, measuring 30×50 feet.
According to an official statement released by the EOW Kashmir, the case originated from a complaint regarding conflicting claims over the ownership of the said plot. While one party asserted rightful ownership backed by a valid chain of powers of attorney from the original allottee, another individual put forth a separate set of documents to stake their claim. This discrepancy raised suspicions of fraud and criminal conspiracy.
Following a thorough investigation that included statements from the complainant, the original allottee, Satish Kumar Sharma, and relevant individuals, it was discovered that an irrevocable General Power of Attorney allegedly granted to the accused in 2010 was never officially registered. The original allottee vehemently denied any involvement in such a transaction.
The investigation further unraveled the deceptive practices of the accused, identified as Gh. Mohi-ud-Din Dar, who utilized forged documents to falsely assert ownership of the plot and engage in subsequent transactions. Verification from the J&K Housing Department ultimately affirmed the complainant’s legitimate ownership.
Consequently, the EOW Kashmir has built a strong case under Sections 420, 467, 468, and 471 of the IPC and has presented the chargesheet for judicial review.
In a statement, the EOW Kashmir emphasized its commitment to combatting fraudulent activities related to land and housing properties. Any attempts to unlawfully seize public assets will be met with strict legal repercussions.
The diligent efforts of the EOW Kashmir in uncovering and addressing instances of property forgery serve as a reminder of the importance of upholding integrity and transparency in real estate transactions.
